Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and BidSignal, a service of Far West Interactive ("BidSignal," "we," "us," or "our"), governing your use of the BidSignal website, dashboard, and email alert service (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

BidSignal monitors publicly available building permit data from the City of Austin Open Data portal and emails subscribers a daily digest of permits matching their selected trade and zip codes. Permit data is provided by the City of Austin and may contain errors, omissions, or delays; we present it as-is.

2. Accounts

You must be 18+ and authorized to bind your business. You are responsible for keeping your password confidential and for all activity under your account.

3. Free trial & billing

• New accounts include a 3-day free trial of the selected plan.
• After the trial, your card is charged the monthly subscription fee for the plan you selected, and on the same day each month thereafter.
• Fees are non-refundable except where required by law. You can cancel anytime; cancellation stops future charges and the Service continues until the end of the current billing period.
• We may change pricing on 30 days' notice by email.
• Payment processing is handled by Stripe under their terms.

4. Acceptable use

You agree not to:

• Resell, sublicense, or redistribute the alert feed or any compiled list derived from it.
• Scrape, reverse-engineer, or interfere with the Service.
• Use the Service to harass property owners or violate any TCPA, CAN-SPAM, do-not-call, or state telemarketing rules. You are solely responsible for how you contact people based on lead data.
• Share your account with contractors outside your business.

5. Intellectual property

BidSignal owns the Service, including its software, branding, and email templates. The underlying permit records are public-record data and not owned by us. You retain ownership of the information you submit (trade, zip codes, contact info).

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not guarantee that every permit is captured, that estimated values are accurate, or that you will win any particular job.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BIDSIGNAL AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS OR LOST BUSINESS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM.

8. Indemnification

You agree to indemnify and hold BidSignal harmless from claims arising out of your use of the Service or your outreach to property owners or permit holders.

9. Termination

We may suspend or terminate accounts that violate these Terms or create risk for the Service or other users. You may close your account at any time from your settings page.

10. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Exclusive venue for any dispute is the state or federal courts located in Bexar County, Texas.

11. Changes

We may update these Terms; material changes will be emailed to account holders before they take effect.
